Terms of Service

1. Introduction and Acceptance

These Terms of Service constitute a legally binding agreement between you and Apture Ltd., a company registered in Poland, governing your access to the Apture platform and services.

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS.

2. Description of Service

Apture is a B2B SaaS recruitment platform providing AI-powered tools for evaluating candidate resumes against job requirements, including CV analysis, scoring, and recommendations.

3. AI Disclaimer and Limitations

AI systems are non-deterministic and may produce inaccurate outputs. Apture does not warrant AI accuracy.

4. AEDT & EU AI Act Compliance

For NYC users: You are responsible for AEDT compliance (Local Law 144), including bias audits and candidate notices.

Under EU AI Act: You are the "deployer" of the high-risk AI system with corresponding obligations for human oversight.

5. User Obligations

• Use the Service lawfully and in compliance with all applicable laws
• You are the Data Controller for candidate data under GDPR
• Do not discriminate against candidates or make decisions solely on AI outputs

6. Intellectual Property

Apture owns the Service and AI technology. You retain ownership of your uploaded content and receive a license to use AI-generated outputs for internal business purposes.

7. Fees and Payment

Subscriptions (Free, Pro, Ultra, Enterprise) are billed via Stripe. Fees are non-refundable except as required by law.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

9. Limitation of Liability

Apture's total liability shall not exceed the greater of amounts paid in the past 12 months or €100.

10. Governing Law

These Terms are governed by the laws of Poland. Disputes are subject to the courts of Warsaw, Poland.
